{"id":9782,"date":"2019-06-20T08:58:41","date_gmt":"2019-06-20T06:58:41","guid":{"rendered":"https:\/\/www.desertsun.co.uk\/blog\/?p=9782"},"modified":"2019-06-20T08:58:41","modified_gmt":"2019-06-20T06:58:41","slug":"affrayed-to-death","status":"publish","type":"post","link":"http:\/\/www.desertsun.co.uk\/blog\/9782\/","title":{"rendered":"Affrayed to death"},"content":{"rendered":"<p>Here&#8217;s <a href=\"https:\/\/www.theguardian.com\/global\/2019\/jun\/19\/four-teenagers-spared-jail-after-bus-stop-attack-on-student\" target=\"_blank\" rel=\"noopener noreferrer\">another story<\/a> which involves the hierarchy of protected characteristics:<\/p>\n<blockquote><p>Four members of a girl gang who inflicted a \u201csustained and horrific\u201d bus stop attack on a frightened Egyptian student who later died have been given non-custodial sentences.<\/p>\n<p>Mariam Moustafa, 18, suffered a stroke which left her in a coma after being \u201cpushed so hard\u201d that she was slammed against a bus shelter on 20 February last year, and\u00a0died almost a month later on 14 March.<\/p>\n<p>After admitting affray in connection with the street assault, two 18-year-old women, who can now be named as Rochelle Dobbin and Netesha Lewis, and two 16-year-old girls were handed referral orders by a district judge at\u00a0Nottingham\u00a0youth court on Wednesday.<\/p><\/blockquote>\n<p>When news first broke of an unprovoked attack on an Egyptian woman in Nottingham, the media was quick to assume it was racially aggravated. However, when the ethnicity of her assailants became known they fell silent.<\/p>\n<blockquote><p>Lewis launched a violent attack on the student, punching her repeatedly and accusing her of being responsible for a social media account called \u201cBlack Rose\u201d.<\/p>\n<p>Moustafa was punched several times during an attack \u201cfuelled by social media\u201d near a bus stop in Parliament Street, Nottingham, at 8pm, while her friend Pablo Jawara tried to protect her.<\/p><\/blockquote>\n<p>So it was a premeditated attack. Nevertheless:<\/p>\n<blockquote><p>The district judge described the teenagers as \u201caggressive\u201d and said they should be \u201ccondemned\u201d for their actions. They were spared detention because the court should \u201cavoid criminalising young people unnecessarily\u201d and the teenagers could only be sent to custody as \u201ca last resort\u201d.<\/p><\/blockquote>\n<p>Well, we wouldn&#8217;t want to criminalise a gang of girls who beat another to death, would we?<\/p>\n<blockquote><p>At Nottingham\u00a0crown\u00a0court on Friday,\u00a0Mariah Fraser, 20, was ordered to spend eight months in a young offender institution<\/p><\/blockquote>\n<p>For those of you who thought young offenders institutions were for minors, you were mistaken. It seems they&#8217;re for violent adult criminals in cases where judges can&#8217;t bring themselves to put them in prison. <em>The Sun<\/em> has <a href=\"https:\/\/www.thesun.co.uk\/news\/9334074\/girls-vicious-bus-stop-attack-spared-jail\/\" target=\"_blank\" rel=\"noopener noreferrer\">more details<\/a> about the attack:<\/p>\n<blockquote><p>She said: &#8220;Messages were flying around social media by someone called Black Rose and the girls thought that was Mariam.<\/p>\n<p>&#8220;They were shouting things like &#8216;you watch fam, you&#8217;re going to get f***ed up when I see you, I&#8217;ll f**k you up again.&#8217;<\/p>\n<p>&#8220;The six got on off the bus and were shouting abuse at Mariam. It was at this point Mariam collapsed.<\/p>\n<p>&#8220;The defendants seemed unconcerned and were laughing.&#8221;<\/p><\/blockquote>\n<p>You know the legal term <a href=\"https:\/\/content.next.westlaw.com\/5-501-5857?transitionType=Default&amp;contextData=(sc.Default)&amp;firstPage=true&amp;bhcp=1\" target=\"_blank\" rel=\"noopener noreferrer\">protected classes<\/a>? It&#8217;s an American thing but it appears to apply to the UK as well, and it means exactly that.
